ANALISIS PERLINDUNGAN HUKUM ATAS HAK CIPTA TERHADAP PENGGUNAAN LAGU SEBAGAI DATABASE SISTEM ARTIFICIAL INTELLIGENCE TANPA IZIN PENCIPTA

Abstrak

Perkembangan teknologi berdampak terhadap berbagai bidang, salah satunya adalah pada bidang musik dan hak cipta. Teknologi yang berkembang tersebut berpengaruh terhadap adanya potensi terkait tindakan penyalahgunaan yang dapat merugikan orang lain. Kehadiran artificial intelligence merupakan salah satu wujud dari perkembangan teknologi yang terjadi. Artificial intelligence yang semakin canggih membawa persoalan hukum mengenai hak cipta terkait penggunaan lagu sebagai database pada sistem artificial intelligence tanpa izin pencipta. Hal tersebut mengingat karena lagu sebagai ciptaan yang dilindungi undang-undang tidak dapat digunakan secara sembarangan oleh orang lain. Penelitian ini menggunakan metode penelitian yuridis normatif dengan pendekatan case study dan statute approach. Melalui penelitian ini dapat diketahui perlindungan hukum atas hak cipta terhadap penggunaan lagu sebagai database sistem artificial intelligence tanpa izin pencipta dan akibat hukumnya ketika terdapat penyebarluasan melalui media sosial. Hasil dari penelitian ini diharapkan dapat menjadi sumber pengetahuan untuk banyak orang agar supaya perkembangan teknologi yang terjadi dapat dimanfaatkan dengan sebaik-baiknya tanpa menimbulkan kerugian untuk orang lain.

Technological developments have an impact on various fields, one of which is in the field of music and copyright. The developing technology affects the potential for abuse that can harm others. The presence of artificial intelligence is one form of technological developments that occur. Increasingly sophisticated artificial intelligence brings legal issues regarding copyright related to the use of songs as databases in artificial intelligence  systems without the permission of the creator. This is because songs as creations that are protected by law cannot be used carelessly by others. This research uses normative juridical research methods with a case study approach and statute approach. Through this research, it can be known the legal protection of copyright against the use of songs as  a database of artificial intelligence systems  without the permission of the creator and the legal consequences when there is dissemination through social media. The results of this research are expected to be a source of knowledge for many people so that technological developments that occur can be utilized as well as possible without causing harm to others.
