Abstrak

Perkawinan merupakan pertalian yang sah antara seorang laki -laki dan seorang perempuan untuk waktu yang lama. Pengaturan pembagian harta bersama pasca perceraian yang berlaku di Indonesia telah diatur dalam berbagai peraturan perundang-undangan, antara lain Undang-Undang nomor 1 Tahun 1974 tentang Perkawinan dan Kompilasi Hukum Islam. Harta bersama harus dibagi rata jika tidak ada perjanjian kawin. Dalam kasus ini harta bersama yang awalnya dikuasasi salah satu pihak melalui Putusan Nomor 31K/AG/2026 harta dibagi dua antara suami dan istri, walaupun harta tersebut telah dijual saat masih berstatus suami istri atau 4 tahun sebelum bercerai, dengan bukti yang kuat dan proses hukum maka Penggugat (Mantan Suami) mendapatkan hak nya masing -masing oihak 50% : 50%. Putusan besarnya perhitungan pembagian tidak harus 50% masing- masing akan tetapi dilihat faktor penyebab perceraian.

Marriage is a legal relationship between a man and a woman for a long time. The provisions for the distribution of joint assets after divorce in Indonesia have been regulated in various laws and regulations, including Law Number 1 of 1974 concerning Marriage and the Compilation of Islamic Law. Joint assets must be divided equally if there is no prenuptial agreement. In this case, the joint assets that were initially controlled by one party through Decision Number 31K / AG / 2026 were divided equally between the husband and wife, even though the assets had been sold while still married or 4 years before the divorce, with strong evidence and legal process, the Plaintiff (Ex-Husband) received his rights to each party 50%: 50%. The decision on the amount of the division calculation does not have to be 50% each but is seen from the factors causing the divorce.
