PENERAPAN SANKSI OLEH DEWAN KEHORMATAN DAERAH IKATAN NOTARIS INDONESIA (DKD-INI) KOTA BUKITTINGGI BAGI NOTARIS YANG MELAKUKAN PELANGGARAN KODE ETIK

Abstrak

Dewan Kehormatan adalah alat perlengkapan Perkumpulan yang dibentuk dan berfungsi menegakkan Kode Etik, harkat dan martabat notaris, yang bersifat mandiri dan bebas dari keberpihakan, dalam menjalankan tugas dan kewenangannya dalam Perkumpulan. Namun kenyataannya masih banyak notaris yang melanggar kode etik tesebut. Penelitian ini bertujuan pertama mengetahui standar penjatuhan sanksi bagi pelanggaran kode etik notaris, kedua mengetahui penerapan sanksi oleh Dewan Kehormatan Daerah Ikatan Notaris Indonesia Kota Bukittinggi bagi yang melakukan pelanggaran Kode Etik. Metode penelitian ini adalah penelitian hukum yuridis empiris. Hasil dari penelitian ini adalah menjadi standar penjatuhan sanksi oleh Dewan Kehormatan Daerah Bukittinggi Ikatan Notaris Indonesia (DKD-INI) mengacu kepada Pasal 8 Perubahan Kode Etik Notaris Kongres Luar Biasa Ikatan Notaris Indonesia, Banten, 29-30 Mei 2015. Adapun tahap tahap penerapan sanksi yang dilakukan oleh Dewan Kehormatan Daerah Ikatan Notaris Indonesia Kota Bukittinggi adalah pengaduan, peyelidikan, pemeriksaan dan putusan.. Penerapan sanksi yang dilaksanakan oleh Dewan Kehormatan Daerah Bukittinggi Ikatan Notaris Indonesia (DKD-INI) berdasarkan ketentuan Kode Etik Ikatan Notaris Indonesia yang ditetapkan di Banten tertanggal 29-30 Mei 2015, dimana Terlapor dipanggil oleh Dewan Kehormatan Daerah Bukittinggi Ikatan Notaris Indonesia (DKD-INI) untuk didengar keterangannya dalam sidang, ternyata terbukti telah melakukan pelanggaran kode etik, maka keputusan dari Dewan Kehormatan Daerah Bukittinggi Ikatan Notaris Indonesia (DKD-INI) adalah Peringatan Tertulis Pertama.

The Honorary Council is a tool of the Association that is formed and functions to uphold the Code of Ethics, the dignity and honor of notaries, which is independent and free from bias, in carrying out its duties and authorities in the Association. However, in reality there are still many notaries who violate the code of ethics. This study aims to first determine the standard for imposing sanctions for violations of the notary code of ethics, second to determine the application of sanctions by the Regional Honorary Council of the Indonesian Notary Association of Bukittinggi City for those who violate the Code of Ethics. The research method is empirical juridical legal research. The results of this study are the standard for imposing sanctions by the Bukittinggi Regional Honorary Council of the Indonesian Notary Association (DKD-INI) referring to Article 8 of the Amendment to the Notary Code of Ethics of the Extraordinary Congress of the Indonesian Notary Association, Banten, May 29-30, 2015. The stages of implementing sanctions carried out by the Bukittinggi Regional Honorary Council of the Indonesian Notary Association of Bukittinggi City are complaints, investigations, examinations and decisions. The implementation of sanctions carried out by the Bukittinggi Regional Honorary Council of the Indonesian Notary Association (DKD-INI) is based on the provisions of the Code of Ethics of the Indonesian Notary Association stipulated in Banten dated May 29-30, 2015, where the Reported Party was summoned by the Bukittinggi Regional Honorary Council of the Indonesian Notary Association (DKD-INI) to be heard in court, it was proven that he had violated the code of ethics, then the decision of the Bukittinggi Regional Honorary Council of the Indonesian Notary Association (DKD-INI) is the First Written Warning.
