EKSISTENSI DESA ADAT DALAM MENGHADAPI MODERNISASI: PERSPEKTIF SOCIO-LEGAL ATAS REGULASI DAN KEARIFAN LOKAL DI BALI

Abstrak

Eksistensi desa adat di Bali menghadapi tantangan besar akibat modernisasi, globalisasi, dan perkembangan pariwisata. Penelitian ini bertujuan untuk menganalisis dinamika desa adat dalam menghadapi modernisasi, khususnya terkait interaksi antara regulasi negara dan kearifan lokal. Metode penelitian yang digunakan adalah penelitian socio-legal dengan pendekatan normatif melalui kajian peraturan perundang-undangan dan analisis sosiologis. Hasil penelitian menunjukkan bahwa desa adat masih memiliki peran penting dalam menjaga identitas budaya dan harmoni sosial, namun tumpang tindih kewenangan dengan desa dinas serta tekanan modernisasi berpotensi melemahkan fungsi desa adat. Peraturan formal seperti UU Desa dan Perda Desa Adat Bali telah memberikan pengakuan, tetapi belum sepenuhnya mampu menjawab problem aktual yang dihadapi desa adat. Diperlukan harmonisasi regulasi dan revitalisasi kearifan lokal agar desa adat tetap eksis sebagai benteng budaya dan hukum adat Bali di era modern.

The existence of traditional villages in Bali faces major challenges due to modernization, globalization, and the development of tourism. This study aims to analyze the dynamics of traditional villages in facing modernization, particularly in relation to the interaction between state regulations and local wisdom. The research method used is socio-legal research with a normative approach through the study of legislation and sociological analysis. The results show that traditional villages still play an important role in maintaining cultural identity and social harmony, but overlapping authority with administrative villages and the pressure of modernization have the potential to weaken the function of traditional villages. Formal regulations such as the Village Law and the Bali Traditional Village Regulation have provided recognition, but have not been able to fully address the actual problems faced by traditional villages. Regulatory harmonization and revitalization of local wisdom are needed so that traditional villages can continue to exist as bastions of Balinese culture and customary law in the modern era.
