Arbitrase menjadi pilihan bagi pelaku bisnis sebagai lembaga yang menyelesaikan perkara di luar pengadilan karena sifatnya yang lebih praktis, cepat dan hemat biaya. Di dalam penyelesaian sengketa melalui arbitrase, para pihak diberi kebebasan untuk memilih peraturan dan acara yang akan digunakan dalam penyelesaian sengketa mereka. Sehingga prinsip ex aequo et bono dapat diterapkan dalam putusan arbitrase. Hal ini sesuai dengan arahan Pasal 56 UU No 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa. Salah satu putusan arbitrase yang menerapkan prinsip tersebut adalah putusan BANI nomor 43007/I/ARB-BANI/2020. Namun terhadap putusan tersebut telah diajukan pembatalan dan dikabulkan oleh Pengadilan Negeri Jakarta Selatan dalam putusan 582/Pdt.G.Sus-Arbt/2021/PN.Jkt.Sel. Pertimbangan hakim mengabulkan pembatalan putusan arbitrase karena hakim menilai BANI telah salah dalam menerapkan prinsip ex aequo et bono.
Arbitration has become the preferred choice for business entities as an institution for resolving disputes outside the court due to its practical, speedy, and cost- effective nature. In the process of resolving disputes through arbitration, the parties are given the freedom to choose the rules and procedures that will be used in resolving their disputes. Thus, the principle of ex aequo et bono can be applied in the arbitration decision. This is in line with the direction of Article 56 of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution. One arbitration decision that applies this principle is the BANI decision number 43007/I/ARB-BANI/2020. However, an annulment has been filed against this decision and was granted by the South Jakarta District Court in decision 582/Pdt.G.Sus-Arbt/2021/PN.Jkt.Sel. The judge's consideration for granting the annulment of the arbitration decision was due to the judge's assessment that BANI had erred in applying the principle of ex aequo et bono.
