ANALISIS YURIDIS MEDIASI PENYELESAIAN SENGKETA PEMILU BERDASARKAN PERATURAN BADAN PENGAWAS PEMILIHAN UMUM NOMOR 9 TAHUN 2022 TENTANG TATA CARA PENYELESAIAN SENGKETA PROSES PEMILIHAN UMUM

Abstrak

Penelitian ini menjelaskan mediasi penyelesaian sengketa proses pemilihan umum. Pemilihan umum harus menjadi pesta demokrasi yang diwarnai dengan kegembiraan, maulai dari tahapan persiapn, pelaksanaan dan hasil pemilihan umum melalui proses pemilihan yang berintegritas.  Pasal 466 Undang-Undang Nomor 7 Tahun 2017 Tentang Pemilihan Umum, sengketa proses pemilihan umum terdiri dari 2 (dua) jenis yaitu sengketa yng terjadi antarpeserta pemilihan umum dan sengketa antara peserta pemilihan umum dengan penyelenggara pemilihan umum. Mediasi merupakan suatu prosedur penengahan dimana  seseorang bertindak sebagai kendaraan untuk komunikasi antar para pihak, sehingga pandangan mereka yang berbeda atas sengketa itu dapat dipahami dan mungkin didamaikan, namun tanggungjawab agar tercapai suatu perdamaian tetap berada ditangan para pihak itu sendiri. Mediasi penyelesaian sengketa proses pemilihan umum diharapkkan ada kesepakatan diantara para pihak yang bersengketa sehingga dihasilkan penyelesaian sengketa secara win win solution. Sengketa hasil pemilihan umum hanya dilakukan melalui Badan Pengawas Pemilihan Umum (Bawaslu) dan Pengadilan Tata Usaha Negara, namun sengketa hasil pemilihan umum hanya diselesaikan melalui Mahkamah Konstitusi, dan harus ditempuh melalui prosedur mediasi dan adjudikasi.

This research eplains the mediation of dispute resolution in the general election process. General elections must be democratic celebration filled with joy, starting from the stages of preparation, implementation and results of the general election through an election process with integrity. Pasal 466 Undang-Undang Nomor 7 Tahun 2017 pemilihan umum, general election process disputes consist of 2 (two) types, namely disputes that occur between general election participants and disputes between general election participants and general elction organizers. Mediation is a mediation procedure where someone acts as a vehicle for communication between the parties, so that their different views on the dispute can be understood and possibly reconciled, but the responsibility for achieving a peace remains in the hands of the parties them selves. Mediation for resolving disputes in the general election process is expected to result in an agreement between the disputing parties so that a win win solution can be obtained to resolve the dispute. Dispute over general election results are only resolved through the general election supervisory body (Bawaslu) and the state administrative court, but disputes over general election results are only resolved through the constitutional court, and must be resolved through mediation and adjudication procedures.
