EKSISTENSI KODE ETIK ADVOKAT DALAM PERSIDANGAN PERDATA DI PENGADILAN NEGERI MEDAN

Abstrak

Advokat adalah profesi hukum yang memberikan jasa di dalam maupun di luar pengadilan, meliputi konsultasi hukum, bantuan hukum, perwakilan, serta pembelaan sesuai dengan ketentuan peraturan perundang-undangan. Kode Etik Advokat berfungsi sebagai pedoman moral dan profesional dalam menjalankan tugas tersebut. Penulisan ini bertujuan untuk mengetahui  penerapan kode etik advokat dalam persidangan perdata di Pengadilan Negeri Medan, kemudian mengkaji bentuk sanksi terhadap advokat yang melakukan pelanggaran kode etik dan  pengaruh penerapan kode etik advokat terhadap kualitas persidangan perdata di Pengadilan Negeri Medan. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan normatif-empiris melalui wawancara dan observasi langsung. Hasil penelitian menunjukkan bahwa penerapan kode etik advokat berperan penting dalam proses persidangan perdata di Pengadilan Negeri Medan. Kepatuhan terhadap kode etik mendorong terciptanya persidangan yang adil, transparan, dan bermartabat, sedangkan pelanggaran ditindak oleh Dewan Kehormatan Organisasi Advokat melalui mekanisme sanksi yang telah ditentukan.

An advocate is a legal profession that provides services both inside and outside the court, including legal consultation, legal aid, representation, and defense in accordance with statutory provisions. The Advocate Code of Ethics serves as a moral and professional guideline in carrying out these duties. This paper aims to determine the application of the advocate code of ethics in civil trials at the Medan District Court. Then, it examines the forms of sanctions against advocates who violate the code of ethics and the impact of the application of the advocate code of ethics on the quality of civil trials at the Medan District Court. The research method used is qualitative with a normative-empirical approach through interviews and direct observation. The results indicate that the application of the advocate code of ethics plays a crucial role in the civil trial process at the Medan District Court. Compliance with the code of ethics encourages fair, transparent, and dignified trials, while violations are prosecuted by the Honorary Council of the Advocates Organization through a predetermined sanction mechanism.
