PERANAN ADVOKAT DALAM PENYELESAIAN MEDIASI PENAL DI KEPOLISIAN DALAM TINDAK PIDANA KEKERASAN DI TEMPAT UMUM

Abstrak

Penyelesaian tindak pidana kekerasan di tempat umum tidak selalu harus dilakukan melalui proses peradilan yang formal. Salah satu cara alternatif yang bisa dipertimbangkan adalah mediasi penal, yang diadakan dengan bantuan pihak kepolisian. Mediasi ini menerapkan prinsip restorative justice, yang bertujuan memulihkan hubungan antara korban dan pelaku. Dalam proses ini, peran advokat sangat penting, karena mereka bertugas melindungi hak-hak hukum klien, baik yang menjadi korban maupun pelaku. Tugas advokat mencakup memberikan nasihat hukum, mengawasi jalannya mediasi, membantu menegosiasikan ganti rugi, memastikan prosedur yang ditempuh oleh kepolisian sesuai dengan peraturan perundang-undangan, serta menyusun kesepakatan tertulis yang sah. Penelitian ini menunjukkan bahwa ketika advokat terlibat dalam mediasi penal, hal tersebut tidak hanya dapat meningkatkan keadilan dan efektivitas penyelesaian masalah, tetapi juga mendorong terciptanya pemulihan hubungan sosial serta menumbuhkan kepercayaan masyarakat terhadap sistem hukum.

Solving crimes of public violence doesn't always require going through a formal court process. One alternative is penal mediation, which is organized by the police. This approach focuses on restorative justice and helps repair the relationship between the victim and the offender. During this process, lawyers play an important role in making sure the legal rights of both the victim and the offender are protected. Lawyers provide legal advice, support the mediation process, help negotiate compensation, ensure police procedures follow the law, and create a written agreement that is legally valid. This research shows that having lawyers involved in penal mediation not only improves fairness and effectiveness in resolving cases but also helps rebuild social relationships and public trust in the legal system.
