The rapid growth of digital technology-based transactions has triggered the emergence of various digital assets with high economic value, such as crypto assets, Non-Fungible Tokens (NFTs),commercial web domains, and copyrighted software code. However, utilizing digitalassets as debt collateral in financing agreements stillfaces substantive legal uncertainty in Indonesia. This normative legal research aimsto comprehensively analyze the legal problems of encumbering digital assets with fiduciary security from the perspective of propertycriteria under Articles 499 and 503 of theIndonesian Civil Code (KUHPerdata) and Law No. 42 of 1999 on Fiduciary Security. Theresults demonstrate that the dematerialized, anonymous, and volatile nature of digital assets creates a doctrinal conflict with the droit desuite principle, technical limits of electronic fiduciary registration, and execution barriers during parate execution via state auctionoffices. This study recommends regulatory reconstruction and the implementation of Multi-Signature Smart Contract schemes for legal certainty.
