PENYELESAIAN PELANGGARAN KODE ETIK PROFESI TERHADAP APARAT PENEGAKAN HUKUM YANG MELAKUKAN TINDAK PIDANA

Abstrak

Penyelesaian pelanggaran kode etik profesi terhadap aparat penegak hukum yang melakukan tindak pidana. Aparat penegak hukum memiliki peran strategis dalam menegakkan hukum dan menjaga kepercayaan publik, sehingga setiap pelanggaran, baik etik maupun pidana, harus ditangani secara serius dan akuntabel. Pelanggaran kode etik yang disertai tindak pidana tidak hanya mencederai martabat profesi, tetapi juga berpotensi merusak integritas sistem peradilan pidana secara keseluruhan. Oleh karena itu, mekanisme penyelesaiannya dilakukan melalui dua jalur, yakni penegakan hukum pidana dan penegakan kode etik profesi. Penegakan hukum pidana bertujuan memberikan sanksi sesuai peraturan perundang-undangan, sedangkan penegakan kode etik berfungsi menjaga standar moral, profesionalisme, dan disiplin aparat. Keduanya berjalan secara independen namun saling melengkapi. Pembahasan ini menekankan pentingnya transparansi, independensi lembaga pengawas, serta konsistensi penjatuhan sanksi agar tercipta kepastian hukum dan rasa keadilan. Dengan demikian, penyelesaian pelanggaran kode etik terhadap aparat penegak hukum yang melakukan tindak pidana diharapkan mampu memulihkan kepercayaan masyarakat dan memperkuat supremasi hukum.

Law enforcement officers play a strategic role in enforcing the law and maintaining public trust. Therefore, every violation, whether ethical or criminal, must be handled seriously and accountably. Violations of the code of ethics accompanied by criminal acts not only harm the dignity of the profession but also have the potential to undermine the integrity of the criminal justice system as a whole. Therefore, the resolution mechanism is carried out through two channels: criminal law enforcement and enforcement of the professional code of ethics. Criminal law enforcement aims to impose sanctions in accordance with statutory regulations, while enforcement of the code of ethics serves to maintain moral standards, professionalism, and discipline among law enforcement officers. Both operate independently but complement each other. This discussion emphasizes the importance of transparency, the independence of supervisory institutions, and consistent sanctioning to create legal certainty and a sense of justice. Thus, resolving violations of the code of ethics against law enforcement officers who commit crimes is expected to restore public trust and strengthen the rule of law.
